Motivaitor is a coaching and motivating app where users can talk or text with an AI-powered coach to set and achieve their goals, overcome obstacles, and stay focused on their aspirations. These Terms of Service apply to all users and visitors to Motivaitor. By using, visiting, or interacting with Motivaitor via its applications or websites, you agree to these Terms of Service.
Motivaitor is a worldwide service owned and operated by Nunuworks, Inc. When we refer to Motivaitor (“we”, “us" or “our”) in this Terms of Service, we refer to the Motivaitor website, applications, and services only, not to any other services owned or operated by Nunuworks, Inc. When we refer to users (or you), we mean all users and visitors to Motivaitor.
These are Motivaitor's Terms of Service, and they apply to all users of the Motivaitor service. By using Motivaitor you agree to these Terms of Service. Please read them carefully and let us know if you have any questions by contacting us at [email protected]. For information about our data practices, please see our Privacy Policy. We can collect and use your information in accordance with our Privacy Policy.
When you create an account you must provide us with accurate information, in good faith, and you agree to keep your information updated if it changes. You are responsible for anything that occurs when anyone is signed in to your account, as well as the security of the account. Please contact us immediately if you believe your account is compromised.
You are responsible for all activity on your account. If you violate our Privacy Policy, we may terminate your account. Avoid engaging in illegal activities, behaving abusively towards others, or technically exploiting Motivaitor. If you are using Motivaitor's services in the course of generating income, we are not responsible for what you do with your income. Please read our Privacy Policy to learn better how to use Motivaitor appropriately. Our Privacy Policy covers most issues, but if you find a new way to hurt Motivaitor or our users, we reserve the right to take swift action to prevent it.
To become a user, simply login to the Motivaitor app using your Google or Apple Account. Upon joining, you become part of the Motivaitor user community and are granted 45 minutes of AI-powered coaching free of charge, which is equivalent to the average word count discussed in the "How We Calculate Coaching Session Duration" section. After utilizing your complimentary 45 minutes, a subscription is required to continue accessing Motivaitor's services. Please refer to our "Pricing Plans for Motivaitor's Services" section for more details on subscription options and benefits.
On Motivaitor, once you have logged in, you can start an audio call or text message with our AI-powered coach, providing a flexible and accessible way to receive support for your career, relationships, or personal growth. Whether you prefer typing out your thoughts or speaking them aloud, Motivaitor is here to assist you.
Motivaitor offers 15-minute coaching sessions for free for all new users. Motivaitor offers various pricing plans available for monthly subscriptions after the free 15-minute coaching session. Motivaitor's prices may vary from various countries and regions. As such, please visit the pricing plan section within the app or check for our prices on the Apple AppStore or Google PlayStore.
Our prices may change from time to time. Please note that Payments, Currencies, and Refunds for Motivaitor's services are handled exclusively by Apple's App Store and Google's Play Store. Any inquiries or concerns related to billing should be directed to these platforms.
On Motivaitor, you have the flexibility to talk or text with our AI-powered coach at any time or any day. We calculate the duration of coaching sessions based on the combined word count from both you and the AI-powered coach. On average, a person speaks about 100-150 words per minute. Accordingly, a 1-minute session implies that the total number of words spoken or texted by you and the AI-powered coach together is around 100-150 words. Thus the average word count is the total number of words talked or texted by you and Motivaitor combined divided by 100-150 words.
We do not collect Tax ID numbers from our users. You may be required to pay taxes based on your local jurisdiction when you are purchasing any of our services. This is typically shown as an extra tax field during the payment checkout.
Motivaitor is intended for individuals aged 18 and older. Users between the ages of 13 and 18 require verbal or written parental consent before using Motivaitor. It is not suitable for users under 13 under any circumstance.
While Motivaitor strives to provide a secure and supportive platform, it's important to note that the content generated may not be suitable for all users or contexts. Users, and their parents or guardians, should exercise caution, especially when Motivaitor is used by individuals under the age of 18. We encourage parents and guardians to support their child's use of Motivaitor, ensuring a secure and confidential coaching experience.
We do not allow users to discuss or talk about the following topics on Motivaitor:
Terminating accounts is not an action we take lightly and it is done only in the most extreme cases or circumstances. Motivaitor reserves the right to remove a user from participating in any activity on Motivaitor if they violate any of our Terms of Service or Privacy Policy.
As a global company based in Canada, we must comply with economic sanctions and trade restrictions implemented by the Federal Government of Canada. This means that Motivaitor cannot take part in transactions that involve any citizen or people living in those countries. We apologize for the inconvenience this may cause.
We are constantly testing out new features intending to make Motivaitor better. We may add or remove features, and often test features with a random subset of our users. If we believe a feature is significantly different from these Terms of Service, then we explain those differences in the feature trial. With your permission, we may give other websites or services the ability to verify information about your Motivaitor account or perform actions on your behalf. This permission is asked for when you connect your Motivaitor account to other websites or services (integrations). You can learn more about this in our Privacy Policy.
As a user, you can permanently delete your account anytime by going to your Settings. Account deletion doesn't automatically cancel your subscription. If you decide to permanently delete your account, please be aware that all of your data will be erased, but your subscription will remain active until you manually cancel it through the appropriate platform like Apple's App Store or Google's Play Store.
By relying on these established platforms, we ensure that subscription management is seamless and follows industry standards for security and user convenience. Users are already familiar with the process of managing subscriptions through these platforms, which provides a consistent and user-friendly experience.
We reserve the right to terminate or suspend your account at any time at our discretion. We reserve the right to remove any content you may have on Motivaitor at our discretion. We reserve the right to cancel your future privileges to use Motivaitor as well.
You may not bring a claim against us for suspending or terminating your account, and you agree you will not bring such a claim. If you try to bring such a claim, you are responsible for the damages caused, including attorneys' fees and costs. These Terms of Service remain in effect even if you no longer have an account on Motivaitor.
By using Motivaitor to chat with our AI-powered coach, you acknowledge that all your chat data will exclusively be used for enhancing your personalized coaching experience. Motivaitor guarantees that your data will remain private and will not be used for any other purposes. Your data will not be shared, distributed, or used to create derivative works, and it will not be made available to any third parties under any circumstances. You are also reminded not to impersonate another person or infringe upon others' intellectual property or proprietary rights when using Motivaitor.
You may grant Motivaitor access to your third-party accounts for some Motivaitor features to operate. Each time you connect your third-party account, that third-party account will present a page that describes the information that Motivaitor can access. You can revoke Motivaitor's access to those accounts at any time using third-party integration applications.
Our creations are protected by copyright, trademark, and trade secret law. Some examples of our creations are our site, our app, our logo, our icon, and our codebase. We grant you a license to use our logo and icon to promote Motivaitor only. You may use our logo or icon for article publishing and distribution only but you may not edit them in any shape or form before publishing. You may not otherwise use, reproduce, distribute, perform, publicly display or prepare derivative works of our creations unless we give you permission in writing. You will indemnify us from all losses and liabilities, including legal fees, that arise from these Terms of Service or relate to your use of Motivaitor. We reserve the right to exclusive control over the defense of a claim covered by this clause. If we use this right then you will help us in our defense. Your obligation to indemnify under this clause also applies to our subsidiaries, affiliates, officers, directors, employees, agents, and third-party service providers.
Motivaitor is provided “as is” and without warranty of any kind. Any warranty of merchantability, fitness for a particular purpose, non-infringement, and any other warranty is excluded to the greatest extent permitted by law. The disclaimers of warranty under this clause also apply to our subsidiaries, affiliates, and third-party service providers.
To the extent permitted by law, we are not liable to you for any incidental, consequential, or punitive damages arising out of these Terms of Service, or your use or attempted use of Motivaitor. To the extent permitted by law, our liability for damages is limited to the amount of money we have earned through your use of Motivaitor. We are specifically not liable for losses associated with unfulfilled benefits and from losses caused by conflicting contractual agreements. For this clause “we” and “our” are defined to include our subsidiaries, affiliates, officers, directors, employees, agents, and third-party service providers.
We encourage you to contact us if you have an issue. If a dispute does arise out of these Terms of Service or concerning your use of Motivaitor, then the dispute will be resolved in a provincial court located in Vancouver, British Columbia, Canada. Both parties consent to the exclusive jurisdiction and venue of the British Columbia courts to resolve any such dispute. British Columbia law, excluding its conflict of law provisions, governs these Terms of Service, all other Motivaitor Privacy Policy, and any dispute that arises between you and Motivaitor.
These Terms of Service and any referenced Privacy Policy are the entire agreement between you and us and supersede all prior agreements. If any provision in these Terms of Service is held to be unenforceable, then that provision is modified to the extent necessary to enforce it. If a provision cannot be modified, it is severed from these Terms of Service, and all other provisions remain in force. If either party fails to enforce a right provided by these Terms of Service, it does not waive the ability to enforce any rights in the future. We may sometimes make changes to these Terms of Service and Privacy Policy. If we make material changes that adversely affect your rights, then we will let you know before the changes come into effect. Continuing to use Motivaitor after a change means you accept the new Terms of Service or Privacy Policy. These Terms of Service are an agreement with Nunuworks Inc.
